Les ordonnances des 22 septembre et 20 décembre 2017 et la loi de ratification du 29 mars 2018 ont contraint les entreprises, au plus tard le 1er janvier 2020, à fusionner comité d'entreprise, délégués du personnel et CHSCT en une instance unique de représentation : le comité social et économique (CSE). Cette mise en place de la nouvelle instance s'est effectuée au fur et à mesure de l'expiration des mandats existants.
Si le comité social et économique doit être mis en place dans les entreprises d'au moins 11 salariés, il n'exerce l'ensemble des attributions dont étaient titulaires les anciens comités d'entreprise et les anciens CHSCT que dans les entreprises d'au moins 50 salariés : attributions économiques, activités sociales et culturelles et désormais attributions en matière de santé au travail. La mise en place, le fonctionnement et les attributions du comité d'entreprise relevaient, pour l'essentiel, de dispositions d'ordre public auxquelles il ne pouvait être dérogé qu'en plus favorable pour les comités.
Si la mise en place des comités sociaux et économiques est toujours une obligation légale, leur fonctionnement et leurs attributions relèvent en priorité des accords d'entreprise. Il s'agit d'un changement complet de logique puisque le droit applicable est suspendu, dans bon nombre d'hypothèses, soit au résultat de la négociation, soit, à défaut d'accord, sur tel ou tel point, à l'application de dispositions légales supplétives.
A condition de respecter les dispositions d'ordre public, les obligations des employeurs à l'égard des comités sociaux et économiques ont pu être négociées à la baisse par rapport aux dites dispositions supplétives. Ces changements profonds nécessitent leur appropriation par les élus et mandatés, mais aussi par les directions d'entreprises. La 15e édition de cet ouvrage, désormais classique, parfaitement à jour des dernières évolutions législatives (loi Pacte, loi Avenir professionnel) et jurisprudentielles, décrit minutieusement l'état du droit existant et intègre des exemples issus d'accords collectifs sur le fonctionnement et les attributions de la nouvelle instance.
